[:en]Judges in Kosice announced a fee for access to the regional distribution system without a contract unconstitutional.

It is a great success for small producers, he told EurActiv.sk Member of Parliament Charles Galek (SAS). He assessed the decision of the Constitutional Court on the obligation to pay electricity producers for access to the distribution system called G-components.

Galek was among 45 opposition MPs who challenged the ordinance Regulatory Office for Network Industries (URSO) No. 221/2013 Coll. G-component, which came into force in January 2014, the Greens manufacturers also complained before the European Commission.

No contract, no charge

Judges in Kosice on Wednesday, June 22 declared unconstitutional part of § 26 paragraph. 23 RONI Decree. It also introduces a fee for those producers who do not have a regional distribution system operator a contract concerning access to the distribution system and distribution of electricity.

G-component relates in particular to small

Members of the alleged failed G-component itself. If a manufacturer has a contract with the distributor must pay.

„G-component is nezmietol the table,“ says deputy Galek. „But if someone does not use access to the system, there is no reason to pay such a fee.“

Slovak Photovoltaic Industry Association and RES (SAPI), which, when administered to the Constitutional Court cooperated with MPs, calculated the costs of producers for G-component to 72 million euros.

Large supplied to the transmission system

The elimination of taxes reduce costs mainly producers of electricity from solar energy, biogas and biomass. G-component by Galka spent two years 32 million euros. The remaining 40 million euros were paid Slovak plant.

Large plants for electricity production as nuclear power plants do not supply it to the grid, but to the transmission network. The fee is therefore not applicable to them.

„Those who produce the least power, should pay the most. This is illogical, „says the head of EurActiv.sk SAPI Veronika Galeková. The coefficient for the calculation of the fee one assumes the highest for smaller operations.

„We see this as confirmation that Slovakia continues to be the rule of law is a major step for energy self-sufficiency and meet our climate commitments,“ said Galeková by TASR.

The share of green energy grows

Excessive fees, according SAPI also at odds with the European directive on the promotion of energy from renewable sources in 2009. She is therefore the European Commission. That in the main commenced an investigation.

EU executive in addition verifies two other complaints from producers of renewable energy. The first was to withdraw support for over 1,200 producers in 2014. The second case concerns a „stop state“, hence the decision of distribution companies do not connect any other sources of renewable energy to the grid.
